These Terms of Service ("Terms") govern your use of NewTight Equipment Private Limited and website. By engaging our services or using our website, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing our website, requesting a quote, or engaging NewTight's services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and all applicable laws and regulations.

2. Service Description & Policies

NewTight provides professional bolting services for industrial applications including:

Core Services

  • Wind turbine bolting and maintenance.
  • Refinery and petrochemical bolting services.
  • Critical infrastructure bolt installation.
  • Cold Cutting Spark-free cutting of pipes and structures, ideal for hazardous environments.
  • Flange Facing On-site machining to restore flange surfaces and ensure leak-free joints.
  • Emergency bolting services (24/7 availability).
  • Bolt integrity inspections and testing.
  • Torque specification consulting.

Service Standards

  • All work performed by experienced technicians.
  • Compliance with industry safety standards.
  • Use of calibrated equipment and tools.
  • Detailed documentation and reporting.
  • Quality assurance protocols.

Service Policies

  • All site-specific procedures and guidelines will be documented before work begins on-site.
  • Additional fees may be charged if site conditions prevent timely access or create safety concerns that impact the schedule or cost.
  • Site readiness, access provision, and regulatory compliance are the responsibility of the client.

3. Client Responsibilities

Clients must ensure safe working conditions and provide all necessary safety information before work begins.

Site Preparation

  • Provide safe and accessible work areas
  • Ensure proper site security and access controls
  • Supply accurate technical drawings and specifications
  • Coordinate with other contractors and personnel
  • Provide necessary utilities (power, lighting, etc.)

Information & Documentation

  • Provide complete and accurate project specifications
  • Share relevant safety protocols and procedures
  • Disclose any known hazards or special conditions
  • Maintain current insurance and permits
  • Designate authorized representatives for decisions

4. User Obligations

By accessing or using any services, products, or platforms provided by NewTight, users agree to abide by the following obligations. These obligations are designed to ensure a safe, secure, and respectful experience for all users, and to protect the integrity of the NewTight brand and platform.

Accurate Information

  • Users must provide accurate, current, and complete information during registration and when using any of our services. Users are responsible for keeping their account information updated and accurate at all times.
  • Comply with all applicable laws, regulations, and site-specific safety protocols.

Intellectual Property

  • Users may not use, copy, modify, or distribute any content, trademarks, or intellectual property belonging to NewTight without express written permission.

Account Security

  • Users are responsible for maintaining the confidentiality of their login credentials and account information. Any unauthorized use of an account must be reported to NewTight immediately. Users are fully responsible for all activities that occur under their account.

5. Payment Terms

Payment terms are established in individual service contracts. Standard terms apply unless otherwise agreed in writing.

Standard Payment Terms

  • Invoicing: Unless otherwise agreed in writing, payment is due in full within [30] days from the invoice date.
  • Emergency Services: Payment due within 15 days.
  • Disputed Charges: If you believe an invoice is incorrect, you must notify NewTight in writing within 10 business days of the invoice date.
  • Late Payments: 2% monthly service charge.
  • PO: Purchase Orders must be submitted and acknowledged before services begin.

Additional Charges

  • Travel time and expenses for remote locations
  • Overtime rates for work outside standard hours
  • Equipment rental and specialized tooling
  • Standby time due to client delays
  • Additional safety requirements or certifications

6. Limitation of Liability & Indemnification

NewTight’s liability is limited to the total fees paid and excludes indirect or consequential damages. Clients agree to indemnify NewTight against claims arising from misuse, breaches, or third-party actions.

Limitation of Liability

  • The limit of liability will be no greater than the fees paid under the relevant Service or Rental Contract.
  • NewTight will not be accountable for any losses that are not direct or that arise incidentally or as a consequence of other events.
  • Any third-party claims arising from Client’s violation of these Terms or improper Service use shall be indemnified by the Client in favor of NewTight.

7. Warranties & Guarantees

NewTight warrants that all services will be performed in a workmanlike manner according to industry standards and specifications.

Warranty

  • Equipment is inspected before it leaves our facility; please inform us of any defects within 24 hours after you receive it.
  • All warranties, whether express or implied, including those concerning merchantability or fitness for a particular purpose, are disclaimed except where stated in a service-level agreement.
  • All services will be carried out with reasonable expertise and attention, aligned with prevailing industry standards.

8. Cancellation & Changes

Cancellations and changes to scheduled services must be made according to the notice requirements below to avoid charges.

Notice Requirements

  • Standard Services: 48 hours advance notice
  • Emergency Services: 4 hours minimum notice
  • Large Projects: 7 days advance notice
  • Specialized Equipment: 72 hours advance notice

Cancellation Charges

  • Less than required notice: 50% of scheduled service fee
  • Equipment already mobilized: Full mobilization costs
  • Materials ordered: Cost of non-returnable items
  • Crew dispatched: Minimum 4-hour charge

9. Confidentiality & Data Protection

NewTight respects the confidential nature of client information and maintains strict confidentiality protocols.

  • NewTight is committed to protecting all user data and confidential information, ensuring it is handled securely and in compliance with applicable data protection laws. We do not share personal or business data with third parties without consent, except as required by law.

10. Force Majeure

Neither party shall be liable for delays or failures in performance due to circumstances beyond their reasonable control.

  • NewTight shall not be liable for any delay or failure to perform due to events beyond its reasonable control, including natural disasters, war, government actions, or pandemics. Obligations will be suspended during such events. If the disruption exceeds 30 days, either party may terminate the agreement without penalty.

11. Dispute Resolution

NewTight is committed to resolving disputes fairly and efficiently through the following process.

Resolution Steps

  • Termination: Clients may end the agreement by providing written notice, provided all outstanding payments are settled.
  • Termination: NewTight reserves the right to immediately suspend or terminate Services in the event of breach, failure to pay, or improper use of intellectual property or equipment.
  • Governing Law & Jurisdiction: This Agreement is governed by Indian law, and all disputes shall be submitted solely to the jurisdiction of the courts in Maharashtra, India.

12. Modifications to Terms

NewTight reserves the right to modify these Terms of Service with appropriate notice to clients.

  • Changes effective 30 days after written notice
  • Continued use constitutes acceptance of changes
  • Existing contracts governed by terms at time of signing
  • Material changes require explicit agreement

13. Copyright & Trademarks

All content on this Site is safeguarded by the Indian Copyright Act and international intellectual property laws. Any unauthorized use or duplication is strictly forbidden.
